If you are following the proceedings of the Indian parliament, it looks very evident that Congress is going to face a grave crisis in the near future. Now, if the government is serious about initiating constitutionally and legally valid action against Rahul Gandhi, the Leader of Opposition (LoP) and currently the most prominent face of the Congress Party, then he may be entering the gravest political crisis of his career.
Last week, the Parliamentary Affairs Minister had indicated that a Privilege Motion would be brought against Rahul Gandhi. By evening, however, reports emerged that the government had dropped the idea. Instead, Nishikant Dubey submitted a Substantive Motion to the Lok Sabha Secretariat. This shift is not procedural trivia; it fundamentally changes the scope and gravity of the matter.
Friends, most of us will not know the difference between a Privilege Motion and Substantive Motion. A Privilege Motion typically refers a matter to the Privileges Committee, which examines whether a Member of Parliament (MP) has violated the special rights or privileges granted to MPs. The committee investigates and submits a report, after which the Speaker and the House decide on further action. A Substantive Motion, by contrast, is a formal and direct proposal placed before the House with a clearly stated demand. It is not limited to a single speech or incident. It can encompass a broader pattern of conduct.
In this case, the Substantive Motion is centered exclusively on Rahul Gandhi. It is not confined to statements made inside the House. It seeks to examine his overall activities and alleged conduct. After the motion is tabled, it will be debated in the House, and following that debate, Nishikant Dubey will have the right to respond.
The motion reportedly accuses Rahul Gandhi of behaving like ‘Urban Naxal’. It alleges that he travels to countries such as Thailand, Vietnam, Cambodia, and the United Kingdom, and meets individuals who are described as anti-India. The claim is that he is involved in efforts to weaken and divide the country from within. Although the specific word ‘treason’ has not been used, the cumulative meaning of the allegation points in that direction.
The demand attached to the motion is severe: termination of his Lok Sabha membership and a lifetime ban from contesting elections. The seriousness of this demand can not be overstated, if passed, it would not merely suspend him, it would permanently alter his political career.
Rahul Gandhi’s reaction to this is that he is unaffected by such moves- whether it is an FIR, a Privilege Motion or any other action. He has stated that he will continue to speak as he has been speaking. Bit it this motion passes, he may not be able to continue speaking inside the House. Voting on a Substantive Motion is mandatory. The key question is whether the government will allow the matter to proceed to a vote. There has been past instances-particularly motion against Speakers-where matters did not reach voting stage. If voting is allowed, the ruling coalition holds a majority in the Lok Sabha. The motion would pass.
Passage of the motion would mean, the immediate loss of Rahul Gandhi’s membership and as demanded, permanent disqualification from contesting elections. If that happens, what is currently perceived as defiance may quickly collapse. His sense of entitlement, rooted in dynastic politics, would confront a structural end. In a system where political inheritance is passed down, the liabilities of that inheritance follow as well.
After losing the election from Rae Bareilly seat, Indira Gandhi again fought from Chikmaglur and came back to parliament. A similar motion was brought against Indira Gandhi during Janata Party government. Her membership was later cancelled, but no lifetime ban was imposed. She came back to power in 1980.
For Congress, this could represent its biggest crisis in over a decade. If he is disqualified, it is certain that he would continue speaking outside Parliament. It is asserted that he is part of anti-India international toolkit and will continue voicing opposition to the country in every possible forum. Consider the recent trade controversy where he has claimed farmers interest has been compromised. The current trade framework, it is said, has not been fully disclosed, as per government no compromise has made to agriculture, dairy, or fisheries, and these sectors have not been opened to American products. A responsible opposition, it is argued, would wait for the fine print before issuing criticism.
The Substantive Motion, if debated and voted upon, would at minimum remove him from the Lok Sabha. Whether that happens depends entirely on the government resolve. Will it retreat after taking the first step, or proceed further? The claim being made is that tolerating what is described as his anarchic conduct is dangerous-for the country, for society, for youth, and for parliamentary democracy itself.
Congress is now being accused of abandoning hope of returning to power and instead focusing on obstructing the government at every opportunity. If electoral victory is out of reach, the strategy allegedly becomes disruption: create noise, stall proceedings, surround PM, and disregard institutional norms. When Rahul Gandhi says, he fears no one, the interpretation offered is that he considers himself above the constitution and the law.
Two decisions now stand at the center of this confrontation: the government’s willingness to proceed beyond symbolism, and Congress’s willingness to free itself from what is being framed as self-destructive leadership. If he survives this motion, the claim is that the resulting escalation of disorder will exceed anything seen before. If he falls, Congress will have to confront the political abyss into which is has been pushed.
He time of decision has arrived. Either the government advances and makes the first step irreversible, or it retreats. Either Congress chooses survival, or it chooses self-immolation. There is no middle ground left.
