A few days ago, on social media, I read something very disturbing, as it concerned the way our Supreme Court (SC) is working. The article opened up a Pandora’s box as it described how SC is openly practising DESCRIMINATION. There were questions raised by the author, which I am describing it below:
1 Double Standard on the Kashmir Issue
The SC immediately agreed to hear the opposition parties’ petition regarding the abrogation of Articles 370 and 35A. But in 1990, there were atrocities like forced eviction from their homes and occupying their properties, demolition of temples, rape and murder of Kashmiri Hindus. The petition filed on these issues was rejected because it had already occurred long time back.
Is this not a double standard by the SC? This this action of the SC has lead to religious struggle and Hindu community feel they are being discriminated by the apex court.
2 Silence on Misuse of Waqf Board
In the last week the SC has given their order on the new Waqf Act (2025). But in the last 30 years when Waqf board was illegally and forcibly started occupying government’s and other community’s properties, and started operating a parallel system of land occupation- why was the SC silent at that time. If the SC thinks the reforms of Waqf Act is dangerous for Muslim community, then why the SC is accepting construction of masjids and dargahs an Hindu land. Waqf board has forcibly occupied land belonging lakhs of Hindus but the SC remained silent. Our constitution says we are secular and all religion are same and there should not be any bias.
The silence by the SC court shows clearly a religious bias.
3 The earnings of Hindu temples
The earning of Hindu temples is controlled by the government, and this earning is used for funding Madarsas, Haz pilgrimage, Iftaar parties, funding to churches etc but there is restriction on the activities of Hindu temples. Most of the petitions on the issues of Hindu rights are rejected by the SC, and always preference is given to minority communities.
Is this right?
4 Discrimination against Hindu Education Societies and Trusts
In the right to education principle, schools controlled by Hindu societies and trusts have to reserve at least 25% of seats for minority communities. But schools controlled by Muslims and Catholic societies and trusts do not have to follow the 25% reservations for major community.
Why SC is silent on this, is this not encouraging to religious conversion?
5 Mockery of Freedom of Speech
When Hindus speak then it is said that they are spreading hatred, but when minor communities speak then it is termed as there right to freedom of speech. In the recent past Ms Nupur Sharma gave example from Muslim text Hadees, but the court termed her saying as ‘it spreads hatred among Indian citizens. But when MK Stalin and other leaders say the Sanathan Dharam is a disease, the court remains silent.
Is this not discrimination?
6 Biased against Hindu religious practices
The SC has banned the sacrifice of any animal during Dussera but keep mum on the issue of animal sacrifice during Eid festival. During Dahi Handi festival there is restriction on the height of Dahi Handi, but there is no action against violence during Moharram. Diwali crackers are termed as bad for environment as they increase pollution, but there is no restriction of bursting crackers during Christmas and New Year.
Is this not discrimination?
7 Religious places Act
This act stops reinstallation of Hindu temples or idols. As per this act it was made there should not be any change of religious places beginning 15th August 1947. This law prevents Hindus from reconstructing temples which was forcibly converted/destroyed by Muslim rulers. Hindus had to fight for the Ram Mandir for decades, and fight is still going on for many other temples. There are enough proofs with Hindus to show that particular temple was converted/destroyed by Muslim rulers.
The SC does not say anything on this issue and every time they quote the Act of 1947. When they can comment of many other Acts and force the government to amend those Acts. Is this not injustice to Hindus?
8 Why Hindu Tradition are Targeted ?
In Sabrimala’s case the SC court hurt the sentiments of Hindus. It is known facts that many Hindu temples follows the practice of only allowing men or women. Why the court questions the belief of Hindus. In Islam women can not enter Masjids or in certain condition they can read Quran, and Catholic women can not become priest
Why then the SC is silent on these issues?
9 Anti CAA Protestors
The SC did not take any concrete action against the anti CAA protestors. The protestors blocked one of the Delhi’s main road for months, but the SC kept quiet.
Was this not mockery of law?
There are many more such incidents where the SC has done injustice to Hindus. When our constitution says we are secular nation and all the citizens have equal rights, but then why this discrimination on the basis of religion? This question is now being asked by majority community, and in future the government at the centre and the SC has to see that this discrimination on the basis of religion is not there in our society.
