Some thoughts on last Tuesday of Oct 2018.
- Yesterday Supreme Court (SC) took a decision that Ayodhya case will be heard only in Jan after constituting new bench, as the earlier Chief Justice Dipak Misra was part of the bench which was hearing this case. Now as per new Chief Justice Gogoi, new appropriate bench would take up the appeals relating to the title suit in the first week of Jan 2019 and devise the hearing schedule. He further added that the SC court is not hurry to decide highly contentious dispute. So CJ Gogoi has shown his true colours as was pointed out by social and other media that he has got leaning towards Congress, as his father was minister in Congress govt in Assam. You all will remember that earlier Kapil Sibal( Congress) appearing on behalf of Muslim petitioner, had requested the SC to post pone the hearing of this case till the results of next general elections in 2019. So CJ Gogoi has helped the Congress party, because after the constituting the new bench in Jan, and then it will not be possible to arrive at any verdict before 2019 elections. This order has come at a time when politics over Ayodhya is hotting up. The Sangh Parivar is very much upset with the delay in SC’s verdict in this case, and Pressing the govt to go through the Ordinance route and allow the construction of Ram Temple to start. It is rumoured that NDA govt is looking at the option of Ordinance route but they are also considering the political and legal consequences. An ordinance whose aim is to facilitate the construction of temple will be definitely challenged in SC, where appeals relating title suit of lands are pending(Ayodhya case). So on that basis SC might put stay on ordinance, and it will be again stalemate, and govt will also lose face. As for enacting new law to facilitate construction, it is well known fact that Govt lacks the numbers in Rajya Sabha. So bill will not be passed . Congress party should be very pleased because they have achieved what they wanted, that is to delay the verdict, because in their mind they have a doubt that verdict may not be what they are wishing for. If they were so sure of the verdict then why they asked for the postponement of the verdict.
- Congress has got one more leader other than Rahul Gandhi and Digvijay Singh for giving unfounded statements, and that person is Shashi Tharoor. Recently he gave a statement that PM Modi is like a Scorpian who is sitting on Shivalinga. You can not hit him with Chappals as that action will impure the Shivalinga or you can catch it with hands as it might stung you in hands. Earlier also he said some unparliamentry words against Modi, and also said this govt is one man show . I would like to pint out to Shashi Tharoor the following facts: -Has he forgotten his own leader Indira Gandhi who used unconstitutional power and declared emergency and played havoc with the democratic rights of opposition leaders and general public.She even superceeded the SC judges and made judge of her choice as Chief justice of India. At least Modi has not done that knowing that justice Gogoi has leaning towards Congress, but he went with convention of next senior most judge and made Gogoi , who was the senior most judge among the remaining SC judges and made him CJI. So for Congress party conventions and laws are only for name sake, they use them as per their convinience and when they do not suit their purpose they flout them . Classical example was Rahul Gandhi tearing UPA Govt’s ordinance in the press conference. -What was ex PM Mohan Singh’s position in Congress Party and Govt. He was just a figure head , when all the govt’s files were routed through Sonia Gandhi’s office and instructions were passed on Manmohan Singh to act accordingly. Who gave Sonia Gandhi, this extra un constitutional power to act as de facto PM, without any responsibility and obligations to Parliament. She was not answerable for acts and for any blunder PM had to face the consequences. There are many more incidences, where Congress leaders have gone beyond the powers entrusted to them as per constitution, but Congress is one party who behaves differently when in power and when not in power.

It was clear from the Press conference by opposition leaning Judges and Impeachment motion by Congress against Chief Justice Mishra that judiciary is not impartial as we all had believed. It was clearly an agenda of opposition parties to create as much trouble as possible to Modi
