There are few news items which I read today, wish to deliberate briefly the same, with you my friends:

1. Yesterday SC asked Modi govt to set up Special Courts to exclusively hold trials against tainted lawmakers /politicians and cases should be decided with in one year. This is an attempt by SC to put an end to the indefinite delay in prosecution of politicians facing charges in criminal or civil cases. Simultaneously Election Commission (EC) has also called for a life ban on convicted Politicians (like MLAs and MPs)contesting polls. Additionally SC has also asked the list of fresh cases against MPs and MLAs after 2014, till year 2014 there were around 1580 present and ex MPs & MLAs who were facing prosecution in 1.35 lakh cases . Govt have said that they are not averse to special courts. The ruling of SC is in right direction, but are the law makers interested in implementing this order, so that the cases against MPs and MLAs are taken on fast track basis or will they find an excuse. But there should be one rider also in this matter and that is if convicted by this special court then the convicted politician can not appeal in HC and SC, otherwise the case instead getting stuck up in trial court will by lying in HC/SC as these courts are also over burdened, the rider should be such that once convicted you go to prison and then appeal in HC/SC and the no bail to be granted, and as suggested by EC once convicted by special court the ban of can not contest any elections comes into force and the ban will stay even if they are acquitted on some technical grounds. Presently these politicians have made mockery of justice system. Classical example is Laloo Prasad Yadav, who was charge sheeted in Fodder scam in 90s and was convicted by trial court few years back, he appealed against the verdict in HC and roaming outside on bail. Others politicians who were charge sheeted in 2 G Scam, CWG scam, Coal Gate Scam are all outside on the bail, whereas all these scams happened before 2011. There are many more scams and charge sheeted politicians are roaming free, as they are not convicted they can contest elections and again become ministers and do more scams.
I do not know when these scams will end and we will see politicians behind bars, let us hope the direction given by SC in starting Special Court will yield results.

2. Second worth while news is about Bombay HC saying hawking will be permitted only in 221 designated area in Mumbai city. The advocates appearing for Hawker association contented that street vendors/hawkers are covered under Protection of Livelihood and Regulation of street vending act and the law enacted on May 1, 2014. As the state has not formulated any rules under the special law, therefore the designated zones prior to 2014 are not valid. HC said that till the new laws are framed by the govt , the hawkers are authorised to operate only in 221 hawking zones approved by SC in 2009. The HC further stated that no hawking will be permitted within 100 meters from any place of worship, educational institute and hospitals or 150 meters from any municipal or other markets or from any railway stations. No hawking to be permitted on foot Over bridge. The issue has taken a political turn as Congress is backing hawkers’ demands and MNS of Raj Thackrey against the hawkers near stations and other important areas.
Agreed hawkers have all the rights to earn their lively hood but not at the cost of troubling pedestrians on foot path, railway passengers at the entry to stations or FOB etc, secondly I fail to understand why govt can not control the hawkers by marking the designated hawking zones or by not doing so the corrupt politicians and Municipal employees are indulging in corruption be demanding haftas from hawkers.

3. Third news is about Mumbai Municipal Corporation allowing Restaurants on Terraces, they will be allowed in Existing Malls, Hotels having eating houses and lodging services with a conditions that
-Parapet should be of 1.5 meter high
-There should be no residential building within 10 meters of terrace.
-Terraces should be kept open.
-No cooking on terrace using LPG stove or open flame.Only microwave and electric ovens will be permitted.
-To get NOC from Fire dept.
Can someone enlighten me, who can cook food using only Electric and microwave ovens and that too in Restaurants. This is only possible in big hotels where food is cooked in main kitchen and then brought to terrace, and if necessary re heated in ovens. What happens if there is stand alone restaurant. Presently in Mumbai all the Malls generally are having food court on the top floor/ terrace area and they all are using LPG stoves, does it mean that all eating places on the terraces of Mall will have to close.
I wonder, how people sitting in the govt can form these types of rules without using their common sense.

All the three items mentioned above are about the formulation of new system/laws, is govt ready to bell these cats ??????
