Today there are few thoughts which are troubling my mind, and I wish to deliberate on the same

1. From the early stages of our life we have been taught that India is a democratic Republic country, and democracy has three arms -the first being the Legislative body which is controlled by Politicians, and in our country at the Centre they are known as Parliamentarian and the state level they are known as Legislators, city level they are known as Councillors and similarly at District and village level they are members of Zila Parishad and Panchayats; the second arm being the bureaucracy or in the simple language govt employees who implements the policies of the govt and are responsible for the day to day running of the govt establishments and the third and last arm is Judiciary whose job is to see the people/organisations who violate the laws laid by govt and our constitution are brought to justice and see that no unjustice is done to any citizen.

Legislative and bureaucracy for last so many years are facing fire of judiciary for one reason or the other, and specially it happened in UPA 2 rule that Supreme Court was giving direction to both legislative and bureaucracy how to function and was pointing out their mistakes. The position now under NDA rule is slightly better as the performance of legislative and bureaucracy is improving, but the situation has reached at such level, that for any policy framed by govt and passed by parliament is being challenged by Opposition Party or some organisation in HC or SC, because people who are opposed to Modi govt can not tolerate if his govt is doing some thing good for the people as a whole, as all these politicians are only worried about their vote banks and they would like all govts whether state or central to dole out benefits community wise so they can boast in front of their vote banks that they have pressurised the govt to give the benefit. Yesterday there was a classical example in SC when the Judges rapped Bengal Govt headed by Mamata Banerjee when hearing the petition filed by them, challenging the validity of Aadhaar Act in SC, when the law has been passed by Parliament. Bengal govt was told categorically that in the Federal form of Govt, State Govt can not challenge the law passed by Parliament. The Judges further added that state CM Mamata Banerjee can seek a remedy as a common citizen if she felt aggrieved.

The situation has come to such a state that some times it looks like SC is only working for hearing PILs and other petitions filed by the people against the act of Parliament and Govt and even HC spend part its time on hearing such PILs and petitions. Some times I wonder whether SC and HC are meant for such work or giving their views and judgement on the larger issues concerning common citizens, and not spending time on hearing such petitions filed by disgruntled people, who have some axe to grind with govt in power. Same was the case after the demonitisation, as far my knowledge goes it is the prerogative of the govt to change the currency and for this they need not have to announce before hand that they are changing the currency, and friends you have seen the amount of petitions filed by various people in various courts.

Lastly can some one enlighten me , in the democratic form of govt who is supreme Legislative or Judiciary????

2. Second thought which came to my mind is regarding the today’s date ie 31st Oct , it is the day when Indira Gandhi was assassinated. Has Congress party has gone bankrupt as I did not see any advertisement in the newspapers remembering her. When Congress party was in power the advertisements were issued by the central govt media cell and when out power the advertisements were issued by All India Congress Committee. Has Congressmen forgotten the legacy of their leader on whose Gandhi name they have been reaping the benefits, it looks like the present Gandhi Parivar has forgotten the original Gandhi or they believe that her name is not relevant in today’s politics, which revolves around Sonia and Rahul Gandhi.

    1. I think Legislative arm is supreme as long as their legislation is constitutional. S. C. rules against any legislation which is unconstitutional our constitution has rightly provided for checks & balances.
    2. Yes. It is really surprising that Congress has forgotten Indira Gandhi. But I think central government should have remembered her. Her contribution to bifurcation of Pakistan by forming Bangladesh cannot be forgotten.
