In continuation to my yesterday’s blog on judiciary, there is some additional info which I would like to share
- The 4 judges who held press conference had one more issue with CJI and that is about the impartial inquiry regarding death of Justice Loya.
- If you are not aware who was justice Loya, then I would like to inform that he was the CBI judge who was presiding over the case of murder charge against Amit Shah and others in famous Sohrabuddin’s death during riots.
- Justice Loya died of heart attack in Nagpur in Dec 2014 and after new judge presided over the case. It so happened that when the verdict was announced Amit Shah and others were acquitted of murder and other charges by CBI court.
- Since then few activist and Congress Party in particular are insisting that Justice Loya’s death happened in mysterious circumstances and hence the SC should initiate an enquiry on this matter.
- I do not understand what was the issue with these 4 Judges on this matter, because SC is already hearing petitions filed by two people, a journalist Bandhuraj Sambhaji and a Political activist Tehseen Poonawala. These 4 Judges might have grudge against CJI that he did not assigned the case to any of of them and the same was assigned to Justice Arun Mishra, who is number 10 on seniority list. Now Tehseen Poonawala is well known Congress supporter, who appears on many news channels on TV supporting/defending Congress.
- Initially when the Justice Loya died, some political parties instigated his family members and they started saying that he died in mysterious way as he was hale and hearty how can he suffer a heart attack. After the 4 judges referred justice Loya’s death in their Press Conference, Loya’s son held a Press Conference on last Saturday with their family lawyer, and made a statement that they are satisfied with Post Martem report and requested every one in the country not to make a political issue out of his death.
- Today there was hearing in SC on the 2 petitions, where Justice Arun Mishra was presiding. It is reported in the media that yesterday Arun Mishra was crying during the customary morning tea meeting of SC judges and saying that my reputation has been compromised (by these 4 judges) and his competency and integrity is being targetted. It is further reported that CJI Dipak Misra took him to his chambers and one of the said 4 judges J Chelameswar put his arm around Mishra’s shoulder and told him they were not trying raise any issue against him.
- Today in SC, as per last Thursday’s order of SC, the Maharashtra Govt handed over the case documents in a sealed cover to the SC. In a further order the SC directed the Mahrashtra govt to share the information regarding this case with the petitioners, Harish Salve appearing for Maharashtra govt told the SC that govt has no problem in sharing the but requested it should not be made public.
- Now what about integrity and reputation of the judge who acquitted Amit Shah and others, does this mean that judge was corrupt and he compromised his position.
- Lastly I do not understand Congress’s policy, when D Raja & others are acquitted by CBI court in 2G scam case that time they celebrated and said fair justice has been delivered, when every one in the country was surprised by this verdict. When Amit Shah & others were also acquitted by the court, in that case verdict is not proper and it has been compromised and blah blah blah. On the contrary it is the Congress party who has made mockery of judicial system in the country, starting from Indira Gandhi refusing to accept the verdict of Allahabad HC declaring her election null & void and she proclaiming emergency, Rajiv Gandhi going against verdict of SC in Shah Banoo’s case, then no Congress leader was convicted for butchering Sikhs in 1984 and the same Congress Party issued an ordinance against the order of SC in not allowing convicted leaders to contest elections, which was later withdrawn.
In the end my submission to all the politicians is that please do not compromise with this pillar(Judicial System) of democracy as you all have compromised with other three pillars of democracy and they are Administration,Legislative and Free Press/Media.
